05Common questions
What types of security are common in Indonesia?
Mortgages (Hak Tanggungan) over land, fiduciary security over movable assets and receivables, and pledges over shares or accounts. Each must be properly registered to be effective against third parties.
Can a loan agreement be in English only?
Agreements involving Indonesian parties must be made in Indonesian. Bilingual agreements are common and we prepare both versions.
Do you act for lenders or borrowers?
Both. Before we take on a matter we check for conflicts of interest.
